Development Impact Fee Deferral Program (SB 937)
In accordance with Senate Bill (SB) 937, the City has established an Impact Fee Deferral Program as identified in Housing Element Program 2-7 and Chapter 4.14 of the Cotati Municipal Code. Under this program, the payment of certain impact fees in an amount of ten thousand dollars ($10,000) or more may be deferred subject to compliance with outlined terms and conditions. Fees may be deferred until (i) final inspection or (ii) the date the City issues the first Certificate of Occupancy for the Project, except for utility service fees, which the local agency is authorized to collect at the time an application for utility service is received. Impact fees cannot be deferred for more than two (2) years from the date when impact fees would otherwise be due and payable.
The following fee types are eligible for deferral:
- Affordable Housing In-Lieu Fees
- Bed Tax
- Downtown Specific Plan (DSP) Recovery
- Linkage Fees
- Park In-Lieu Fees
- Traffic Impact Fees
- Wastewater Capacity Fees
- Water Capacity Fees
In order to defer development impact fees for a building permit application, you must complete the Development Impact Fee Deferral Agreement and submit the agreement to the Building Department before permit issuance. The Permit Technician will provide an invoice with the remaining permit fees due, including impact fees, once you have received approvals for your building permit application. If you would like to complete the agreement before receiving all approvals, please submit the Fee Estimate Request form to the Permit Technician in order to receive estimates for fees you would like to defer.
